In December of 2017, Khloe Kardashian and Tristan Thompson confirmed they were expecting their first child. Immediately, fans started to wonder if a wedding was on the horizon. While the couple has indicated they are in no rush to get married, we took a look at what legal implications marriage would have for them.
Prenuptial Agreement
Presuming the couple would get married in the United States, where prenuptial agreements are largely enforced, provided certain formalities are met, it is likely they would be advised to get a prenup prior to marrying each other so as to protect their individual assets. Thompson, as the highest drafted Canadian to play in the NBA, has created his own legacy, and also started the Amari Thompson Fund, an epilepsy foundation started for his brother, who suffers from the condition. Thompson would likely wish to protect his career, the foundation, as well as set aside funds to go to the previous son he has with model Jordan Craig.
Khloe Kardashian is estimated to be worth $40 million, mainly built through her participation in the ‘Keeping up with the Kardashians’ shows and several spin-offs which are focused on her solely, as well as through working with brands and magazines. As in the case of her boyfriend, it is likely she would wish to protect these assets and her career.
The prenuptial agreement would also need to contain provisions on any properties that either Kardashian or Thompson own. The agreement would likely also set out a plan for the child the couple is expecting, although courts are more hesitant to enforce prenuptial agreements with regard to children, where the guiding principle is the best interest of the child first and foremost.
Name
It is likely that Kardashian and Thompson would both choose to keep their last names, and not adopt that of their spouse, as they have both achieved substantial name recognition with their current last names. ‘Keeping up with the Kardashians and Thompsons (or Kardashian-Thompsons)’ does not have quite the same ring to it!
The couple have indicated that they are in no rush to get married, and are excited to be expecting their first child. Marriage brings with it substantial legal considerations, and it is a good idea to ask a lawyer for advice before entering into any legal arrangement, including marriage.
